This Policy describes how we, Fusion Media Limited and its affiliated entities ("We" or "Investing.com"), collect and use your personal data when you apply for a job with us.
Data We Collect from You
We collect personal data that you provide during the application process. In certain instances, as detailed below, we may also collect information from additional sources and third parties. Personal data includes any data that may be used to identify you, including, but not limited to:
- Identifying information, such as your full name, email address, phone number, residential address, government identification number, work permit/visa information, and other contact information.
- Professional and employment information, such as your resume, cover letter, work experience, professional references, school history, education and professional qualifications, etc.
- Information you voluntarily provide during the recruitment process, such as demographic information, gender, race, ethnicity, and disabilities, but only when permitted under applicable laws.
- Information received from third parties, as further detailed below.
- Additional data provided by you as part of your application for a job with us, or information collected through personal interviews.
Legal Basis for Processing Personal Data
We process your personal data on the following legal basis:
- The processing is necessary to take steps at your request, prior to entering into a contract regarding your employment/engagement with Investing.com, including reviewing your application and conducting the recruitment process.
- For our legitimate interests in managing recruitment efficiently, assessing your suitability, maintaining records of recruitment decisions, and defending legal claims, all subject to your interests and fundamental rights not overriding those interests.
- Where processing is required by applicable employment, tax, or regulatory law in the jurisdictions in which we operate.
- Where you have provided us with your consent.
Special Category and Sensitive Data
We will only process Special category data where you have given explicit consent or where processing is required or permitted by applicable employment law.
Data We Receive from Third Parties
We may receive your data from third parties. This may include personal data you submit to us through third-party platforms, or data available to us through third parties, which include, without limitation:
- Job boards (such as LinkedIn, GlassDoor, Indeed and others, if you apply to a job through such platforms).
- Third party hiring agencies, such as headhunters and placement firms.
- Other stakeholders through which you can apply for a position with us, e.g. people who may recommend you for a position.
- Publicly available information published by you online, including your public LinkedIn or other social media profiles.
- Results of a pre-employment assessment conducted by a third party firm, including candidate assessments, background checks, security and integrity testing, etc.
Any data we receive from third parties as part of your job application will be subject to this Privacy Policy. However, please note that such third parties' use may be conditional on your acceptance of their privacy policies, for which we assume no responsibility.
Use of Automated Systems and Artificial Intelligence
We may use automated tools, including artificial intelligence (AI) tools, to assist in reviewing and screening job applications and resumes. This can include, for example, helping us to efficiently screen applications by comparing the data included in the applications against the criteria of the position, in order to rank the applications and identify candidates whose skills and experience align with job requirements. Such tools are used to support our human recruiters and help us manage the high volume of applications more effectively. These tools do not make hiring decisions autonomously. All outputs of any automated or AI tools are subject to human review by our recruitment team, and all final decisions are made by our recruitment team, based on a comprehensive consideration of various factors.
Data Sharing and Discovery
We may transfer your Personal Data to other companies or third parties, as follows:
- With our service providers that provide us with services related to the application process, such as recruitment management software, hiring platforms, storage tools, external screening and evaluation institutes, etc.
- With our corporate affiliates, as needed as part of the application and evaluation process.
- To your previous employers and references, as needed to perform employment verifications and professional-reference checks.
- In any event there is a legal obligation to provide the data to third parties or competent authorities, or if urgent circumstances require such transfer, including for reasons of protecting public safety, your own security, or our assets.
- In the event of legal proceedings relating to your employment, non-employment, termination of employment, hiring procedure, or any similar proceeding.
- In the event your personal data was provided to us through a third-party agency, we may communicate certain personal data to such third-party agency in order to facilitate the hiring process.
- To other recipients with your consent.
International Data Transfers
Your personal information may be collected in, transferred to, accessed from, or stored in a country other than the one you are in, including the United States, which may have data protection rules that are different from those of your country.
Your personal information is only transferred out of your country in accordance with applicable data protection law, including, for example, to third countries that adequately safeguard personal data, or under the European Commission-approved Standard Contractual Clauses.
Data Retention
We will store and use your personal data for as long as necessary to fulfill the purposes for which we collected the data. If you are considered for a position at Investing.com and your candidacy is unsuccessful, you decline our offer, or you withdraw your application, we will retain your personal information only to consider you for potential future positions, or for archiving and backup purposes, and to the extent required by law, for tax audits and financial statements, and for conducting legal proceedings or defending against them.
If you do not want us to retain your personal information to consider you for potential future positions, you may request that we delete it as described below. Please note, however, that we may retain some information that we are required to retain by law or in order to defend ourselves in the event of a legal claim.
If you are offered and accept a position with us, your personal information will become part of your employment record.
Your Rights
Subject to applicable law, you have the following rights with respect to your personal information:
- You have the right to access your personal data.
- You have the right to request that we correct any inaccuracies in your personal data.
If the General Data Protection Regulation of the EU/UK applies to you, you are also entitled to the following:
- You have the right to request that we erase your personal data, under certain conditions.
- You have the right to request that we restrict the processing of personal data, under certain conditions.
- You have the right to object to our processing of personal data, under certain conditions.
- You have the right to request that we transfer the personal data collected by us to another organization, or directly to you, under certain conditions.
- Where our processing is based on your consent, you have the right to withdraw your consent at any time.
